BuzzrdAI provides an AI-powered virtual receptionist service designed for service businesses. Our service includes:

The service operates by forwarding your business phone calls to a BuzzrdAI phone number, where our AI receptionist answers and handles calls according to your configured preferences.

You acknowledge and agree that:

• Our service uses AI voice technology provided by third-party partners to conduct phone conversations
• AI-generated responses may not always be accurate or appropriate for every situation
• The AI is designed to gather information and is not a substitute for human judgment in emergencies or complex situations
• You are responsible for reviewing call transcripts and following up with callers as appropriate for your business

By using BuzzrdAI, you understand and agree that:

• All calls handled by BuzzrdAI are recorded for quality assurance, service improvement, and your business records
• Our AI receptionist provides disclosure to callers that the call may be recorded
• You are responsible for ensuring compliance with all applicable call recording laws in your jurisdiction and the jurisdictions of your callers
• Call recordings are retained for 90 days; transcripts are retained for 1 year

As a BuzzrdAI customer, you agree to:

• Account Security: Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access
• Accurate Information: Provide accurate, current, and complete information during registration and keep your account information updated
• Lawful Use: Use the service only for lawful business purposes and in compliance with our Acceptable Use Policy
• Call Forwarding: Properly configure call forwarding from your business phone to your assigned BuzzrdAI number
• Prompt Follow-Up: Review notifications and call summaries in a timely manner and follow up with callers as appropriate

Pricing: Current pricing includes Starter ($297/month), Growth ($497/month), and Pro ($797/month) plans, each with a $250 one-time setup fee. Call usage beyond your plan limit is billed at $3.50 per additional call.

Billing Cycle: Your subscription renews automatically each month on the anniversary of your start date. You will be charged the applicable subscription fee plus any overage charges from the previous billing period.

30-Day Money-Back Guarantee: If you are not satisfied with BuzzrdAI, you may request a full refund of your setup fee and subscription payments within 30 days of your initial purchase. See our Refund Policy for details.

No Late Fees: We do not charge late payment fees. However, if payment fails, your service may be suspended until payment is received.

Price Changes: We may modify our pricing with 30 days' advance notice. Continued use of the service after a price change constitutes acceptance of the new pricing.

BuzzrdAI Property: The BuzzrdAI service, including all software, AI models, algorithms, user interfaces, designs, and documentation, is owned by BuzzrdAI and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the service during your subscription.

Your Content: You retain ownership of any content you provide to configure your AI receptionist, including your business name, greeting scripts, and special instructions.

Feedback: If you provide suggestions, ideas, or feedback about the service, you grant us a royalty-free, perpetual license to use such feedback to improve our service.

Your Call Data: You own the data from calls to your business, including caller information, transcripts, and recordings. We process this data on your behalf to provide the service.

Data Access: You can access your call data through your dashboard and may export it at any time. Upon account termination, you have 30 days to export your data before it is permanently deleted.

Data Processing: We process your data in accordance with our Privacy Policy. Enterprise customers may request a Data Processing Agreement.

We do not warrant that:

• The service will be uninterrupted, timely, secure, or error-free
• The AI will correctly understand or respond to all callers
• The service will meet all of your specific business requirements
• Any errors in the service will be corrected

You acknowledge that AI technology has inherent limitations and that human oversight of call handling is your responsibility.

Exclusion of Damages: To the maximum extent permitted by law, BuzzrdAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, business opportunities, or goodwill, regardless of whether we were advised of the possibility of such damages.

Maximum Liability: Our total cumulative liability for any and all claims arising from or related to the service shall not exceed the total fees actually paid by you to BuzzrdAI during the twelve (12) months immediately preceding the event giving rise to the claim.

Exceptions: These limitations do not apply to liability arising from fraud, gross negligence, willful misconduct, or our indemnification obligations.

You agree to indemnify, defend, and hold harmless BuzzrdAI, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from or related to:

• Your use of the service
• Your violation of these Terms
• Your violation of any applicable laws or regulations
• Any claims by third parties (including your callers) related to your use of the service
• Content or instructions you provide to configure your AI receptionist

Termination by You: You may cancel your subscription at any time through your account dashboard or by contacting support. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months, except under our 30-day money-back guarantee.

Termination by Us: We may suspend or terminate your account immediately if you:

• Violate these Terms or our Acceptable Use Policy
• Fail to pay fees when due after notice and opportunity to cure
• Engage in fraudulent or illegal activity
• Use the service in a way that harms other customers or our infrastructure

Effect of Termination: Upon termination, your access to the service will cease. You have 30 days to export your data. After 30 days, your data will be permanently deleted in accordance with our data retention policy.

Informal Resolution: Before filing any formal legal action, you agree to contact us at support@buzzrdai.com and attempt to resolve the dispute informally for at least 30 days.

Jurisdiction: Any disputes that cannot be resolved informally shall be brought exclusively in the state or federal courts located in Pinellas County, Florida. Both parties consent to the personal jurisdiction of such courts.

Small Claims: Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by:

• Posting the updated Terms on our website with a new "Last Updated" date
• Sending an email notification to the address associated with your account

Material changes will become effective 30 days after notice. Your continued use of the service after changes become effective constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must cancel your subscription before they take effect.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, Acceptable Use Policy, and any other policies referenced herein, constitute the entire agreement between you and BuzzrdAI regarding the service and supersede all prior agreements, understandings, and communications, whether written or oral.

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
